These terms and conditions govern your use of the The Empathy Project. By accessing this website, you agree to abide by these terms and conditions.
Article 1: General Terms

These general terms and conditions/house rules apply to all agreements between The Empathy Project and the person using the facilities of The Empathy Project (hereinafter referred to as "the member" or "the members"). These terms and conditions apply to the location of Klaprozenweg 11, 1032 KK Amsterdam Noord. The Empathy Project reserves the right to refuse members in case of misuse of the membership system or the facilities of The Empathy Project. The use of additional facilities, such as showers/bar and lounge area, does not confer any rights. In case of lack of or malfunctioning of these facilities, no refund of subscription fees will be provided.

By registering, the member declares to be familiar with and accept the general terms and conditions and house rules of The Empathy Project. The Empathy Project is entitled to unilaterally amend the general terms and conditions / house rules. Amended general terms and conditions / house rules apply to both new and existing members. The Empathy Project will inform members in advance of any changes to the general terms and conditions / house rules.
Article 2: Registration, Membership, Payment & Cancelation Payment

Registration is done at the reception desk. Upon registration, a valid form of identification (passport, ID card, or driver's license) must be presented if requested. These details must match the information provided during registration. The member signs a form agreeing to the registration and the general terms and conditions.

Membership starts on the date of registration as stated under "start date of membership". The membership fee is collected in advance. Different conditions may apply during promotions. If you become a member during the month, it will be prorated based on the remaining days of that month. Mid-term cancellations of the membership are not possible. Single lessons and class passes must be paid in full in cash or by card before use. If no cancellation is made, yearly contracts will automatically convert to a monthly cancelable subscription after the contract period. Cancellation can only be done via email (info@theempathyproject.nl). In case of overdue payment, where the member claims to have already canceled, the confirmation email must be shown. In the absence of this, the collection agency will handle further proceedings.

The Empathy Project reserves the right to terminate a membership in case of serious or repeated violation of the house rules or other unacceptable behavior, as indicated by the manager or authorized employee. From the moment the member is in default, all overdue and yet to be paid installments become immediately due. In such cases, The Empathy Project reserves the right to deny the use of facilities to the member. Absence of the member, for any reason, does not exempt the member from the obligation to pay the due membership fees and does not entitle the member to any reduction in membership fees or contributions. The Empathy Project reserves the right to annually adjust membership fees based on indexation. No rights can be derived from promotions or special offers.

You can choose to pay all due installments for the entire contract period at once, or in equal monthly instalments. You are required to ensure receipt of the emails and maintain the account from which The Empathy Project is authorized to collect. Administrative fees and any pro rata amounts must be paid by card or IDEAL before the first visit. Contribution will be debited around the 23rd of the month.

Terminating the membership prematurely is generally not possible. Only in very exceptional circumstances can The Empathy Project decide to accept a premature termination; this is solely at the discretion of The Empathy Project.

In the event of a premature termination, with a notice period of two months, a recalculation of the owed weekly fee will be made based on the actual number of weeks the agreement has been in effect (including the notice period), against the current weekly fee of the shortest membership. This will result in an additional charge.

The use of equipment, participation in a training, program, or any activities of any kind at The Empathy Project is entirely at the member's own risk. The member indemnifies The Empathy Project, the manager, and other employees and/or any other assistants against any personal injury (material or immaterial) resulting from accidents or injuries to the member and/or third parties, arising in any way whatsoever. The Empathy Project, the manager, and other employees and/or any other assistants do not accept any liability for damage, loss, or theft of property belonging to the member and/or third parties. The member is liable for damage caused to property belonging to The Empathy Project if such damage is due to the member's negligence and/or fault.
Article 5: Personal Training and Attendance Group Classes

As a participant of group classes, you are not assigned to a specific personal trainer. When booking a personal trainer you will be, when discussed, assigned to a specific personal trainer.

All personal training sessions are by appointment. You are responsible for scheduling the training sessions by yourself. If you are unable to attend a private or shared training, it may be rescheduled up to 24 hours prior to the appointment. This training session will then be rescheduled within the same week, if possible.

If you cancel within 24 hours prior to the personal or shared training, it will be considered as a completed session that cannot be rescheduled.

For minor injuries (e.g., stiff neck, sprained ankle, or strained wrist), training sessions will continue, albeit in modified form. For severe injuries or serious illness, you should contact the personal trainer. After consultation, the membership will be suspended for the duration of the injury or illness.

If the personal trainer is absent, you can expect a suitable replacement. In case no replacement is available, both payments and training sessions will be suspended.

These terms and conditions shall be governed by and construed in accordance with the Dutch law and any disputes relating to these terms and conditions shall be subject to the exclusive jurisdiction of the courts of The Netherlands.
